GACC: Cancel the Record for Imported Food Label

 
On April 22, 2019, the General Administration of Customs of China (GACC) issued Announcement No. 70 [2019] of the General Administration of Customs of China (Announcement on the Supervision on Labels of Imported and Exported Prepackaged Food). The announcement clarifies that cancel the record for the label of first imported prepackaged food, and import agency is responsible for label.
 
The key points of annoucement are: 
 
1. Constantly review imported food label. Cancel the record for the label of first imported prepackaged food from October 1, 2019. The customs shall inspect the label of imported food as one of compulsory exam items. The products which not comply with Chinese labeling regulations and standards may not be imported to China.
 
2. Import agency is responsible for label. Import agency should review the compliance of the imported food labels. Import agency should submit to the customs the qualified certification materials, the original and translated labels of the imported pre-packaged food, the Chinese label sample and other certification materials, if the prepackaged food is sampled for inspection.
 
3. Supervising customs may punish, if:
 
customs receives a notice by other administrative departments about non-compliant label;
 
customs receives a notice by consumers about the non-compliant label of imported food.
 
4. Implementation scope: goods imported through general trade mode. Imported display products, samples, tax-free goods, prepackaged food for embassies, products through passenger carrying entry, post parcel, express package or cross-border e-commerce should comply with relevant regulations.
 
5. Exported prepackaged food should guarantee the label is consistent with destination standards or contract requirements.
